Secret video raises questions about bakery leader's role in Bailey killing
By Thomas Peele, Bob Butler, Mary Fricker and Josh Richman
THE CHAUNCEY BAILEY PROJECT
Article Created: 06/18/2008 10:20:17 PM PDT

Your Black Muslim Bakery leader Yusuf Bey IV kept the gun used to kill journalist Chauncey Bailey in his closet after the attack and bragged of playing "hella dumb" when investigators asked him about the shooting, according to a secretly recorded police video.

He describes Bailey's shooting in detail on the video, then, laughing, he denies he was there, and boasts that his friendship with the case's lead detective protected him from charges.

Bey IV has not been arrested in Bailey's Aug. 2 death; Devaughndre Broussard, a then-19-year-old bakery handyman, has been charged in the killing. In an interview last week at the Santa Rita Jail in Dublin, where he is being held on unrelated kidnapping and torture charges, Bey IV, 22, denied any role in the killing.

The video and scores of other documents and police recordings obtained by the Chauncey Bailey Project raise questions about Bey IV's possible role in a conspiracy to kill Bailey, who was working on a story about the financially troubled bakery.

The videotape and documents incriminate Bey IV, said one expert who reviewed them.

"All of those things together make it a very powerful, compelling set of facts that Yusuf Bey was involved and that Yusuf Bey should be charged, at a minimum, as an accessory to murder," said Peter Keane, a veteran criminal lawyer and dean emeritus of Golden Gate University Law School.

Oakland police and prosecutors in the Alameda County District Attorney's Office refused requests for interviews. Police would not allow reporters to interview the case's lead detective, Sgt. Derwin Longmire.

"The investigation is still ongoing," Oakland police Assistant Chief Howard Jordan said earlier this month. "We aren't done with this."

In the video, Bey brags of mocking police and keeping the sawed-off shotgun a masked gunman used to shoot Bailey three times at point-blank range.

"I had it in my room the whole time after it happened," Bey IV said.

In the video, Bey IV jerks back his head to mimic a shotgun blast to the face, saying, "Pow, pow! Poof!"

More than 10 months have passed since Oakland police arrested Broussard, now 20. He confessed to the killing, but he has since recanted and pleaded not guilty. His trial has yet to be scheduled.

The documents and recordings give no indication police challenged inconsistencies in statements given by Bey IV and Broussard; nor do they indicate Bey IV was ever questioned about statements on the video regarding his description of Bailey's death or possession of the shotgun.

The documents also raise questions about the accuracy of the lead detective's summation of evidence used to charge Broussard. The summary attributes words and details to Broussard that do not appear in the confession as recorded or in the detective's notes of it.

Collusion by any other name...

(…Dang!)

I remember seeing this story profiled on 60 minutes a few months ago:

http://www.cbsnews.com/stories/2008/02/22/60minutes/main3861939.shtml

As obvious as it all seems, it doesn’t look as if there will ever be a conviction.

(…How come the police wouldn’t take the time to enhance the audio?)

And by virtue of the enhancement, it already seems as if the tape would be wide open to charges in court that it was ‘doctored’ to make it appear they were saying things they weren’t!

(…But if these guys were just ‘role playing’ as they say, then they’ve all missed their calling as thespians!)

I don’t see where anybody will be rolling over on anyone else involved anytime soon…

Independent Investigation

There is a truth rally for Justice 8/2/08 in front of the Bakery calling for an independent investigation of CB murder and the multi year, multi agency COINTELPRO operation being run on the Bakery at the time of Chauncey Bailey's death.

1st CB was working on a story about OPD infiltration and who really was running the Bakery then he gets murdered the day before a RAID on the Bakery that wraps his case up nice and neat with a "confession" that they refuse to admit is janky at best?

Time for law enforcement to show their hand

"There is a truth rally for

"There is a truth rally for Justice 8/2/08 in front of the Bakery calling for an independent investigation of CB murder and the multi year, multi agency COINTELPRO operation being run on the Bakery at the time of Chauncey Bailey's death."

Y'all need to give this conspiracy stuff a rest. The only conspiracy happening there was the plot to murder Chauncy Bailey. The Oakland cops and the FBI were not involved. The Bakery has been a cesspool for years.

Head in Sand

Pt. Cruiser,
Conspiracy:
Law." An agreement between two or more persons to commit a crime or accomplish a legal purpose through illegal action."

You probably think the Government is run by honest patriots who have everyones best interest at the heart of everything they do. If you checked out on history you will see that the truth comes out after the media fact, Your opinion is100% shaped by and a victim of propaganda. There's enough evidence that OPD was involved just in the proven intervention of Longmire repeatedly on IVth's behalf as well as how many times he wasn't taken into custody during traffic stops on known warrants or the multiple bails he was on that had to be approved by the DA. Since he was obviously in financial trouble he wasn't buying influence.
1. If Longmire is a corrupt cop, then why leave him on the case since his actions are tantamount to accessory to Chauncey's murder.
2. If they had just done their job, there wouldn't have been a murder of Chauncey Bailey, they knew about the eveidence of the kidnapping for over 3 months
3. Why not keep the Mayor in the loop that there was an active investigation and the biggest impending raid in Oakland history?
4. If its basic incompetence ( the G Bush excuse for 911 and WMD ) why isn't the media/public calling for the Chief's head?
When it comes out how much time and resources were put into the operation you sheeple will scratch your collective a** and swear you didn't see it coming ( see Liberty City 7 ). flash an image of the flag and the heil salutes and freedom fries are on auto pilot. pull your head out and you will find you can see much clearer.
Oh yeah for the record 911 was an inside job,

Sandman - You have

Sandman -

You have absolutely no idea who I think the government is run by and to whose benefit. BTW, are you referring to the City of Oakland and its recently fired city administrator? Or do you have some other government(s) in mind?

Duh

Your right unless you state it clearly your vague statements are open to interpretation, Myself...For the record start with OPD ( city) who admitted that they were working in conjunction with, to quote the Chief himself "our Federal cousins" ( federal obviously) then go to the DA ( county ) and since we know they coordinate with (State) Homeland security who notoriously infiltrated and spied on citizens protesting before the IRAQ WAR collecting data on peaceful protesters in cahoots with OPD and FBI. That's City, County, State and Federal government entities involved,What other Government could you be talking about? Multiple entities colluding in secret by dictionary definition is a conspiracy.

And for the record, this started way BEFORE Dellums under Jerry Brown now holed up in Sacramento in the AG office and a direct conflict of interest in any investigation of Oakland.. so the myopic disease you have in wagging your finger at local cronyism misses the point, if your worried about your safety and/or property value in Oakland you'll have to go farther back than the current cast of characters in city hall and look at the amount of law suits and federal mandates OPD is under to clean up their crooked act after Jerry Brown replaced Chief Samuels ( incidentally lowest city crime and murder statistics of the last four chiefs )

So please do your research and don't try to fight facts with emotions or media talking points.

"So please do your research

"So please do your research and don't try to fight facts with emotions or media talking points"

I'm sorry, brother, but you have not presented any facts. Get back to me when you are ready to do so. BTW, you should know that I was born on California Street in the city across the Bay and lived there most of my life. I have relatives and close friends (from kindergarten forward) who live in Oakland and some of whom work for the city and the Alameda D.A.'s office and the Sheriff's Department. Please note, my man, that none of them are sheep or handkerchief heads.

Credentials

Your Bay Area credentials, including your friends and relatives are duly noted, how ever since I don't know and never referenced one of your friends and or relatives I don't know why you are defending their "blackness" with me. Since I never made a blanket statement about every employee of every agency I referenced. For the sake of argument, I'm sure if you "vouch" for them they are OK, unless in fact they are one of the people I clearly named, then I disagree.

As for facts, obviously you chose not to read the post and just took it personally with rocks in your jaws because you were called on a flippant statement, quote "The Oakland cops and the FBI were not involved"

That is an opinion based upon an emotional feeling about the Bakery, since you stated you have "friends" in the DA's office and the sheriff's department I can see where your law enforcement bias may have originated. As for facts, feel free to "Google" COINTELPRO, OPD, FBI and you will see your blanket statement shredded quite quickly. Here's a fact, At the time the Panthers were vilified in the press, but remove the government provocateurs and the dirty tricks and the organization would be a powerful black political and social force today...hmmm please see Geronimo Pratt, Fred Hampton, Bobby Hutton etc etc.. or even modern day Liberty City 7 case for FBI infiltration and organization steering.

Now in relation to the subject which is the Chauncey Bailey murder, Brother, you really don't know what you are talking about, I don't know someone who knows someone whose friend works in an office or department. Have you followed this case from day one as I have? Did you know Chauncey Bailey personally as I did? Have you read all the articles and spoke with persons involved and close to the case as I have? Have you spoken with the investigative reporters as I have? Since the answer is no .brother you should humbly submit to superior knowledge ( about this case anyway ) and stop wasting valuable time arguing about the semantics of law enforcement illusions.

I will state it again, On August 2nd 2008 there will be a Rally for Truth and Justice regarding this case, if OPD was forth coming and everything was satisfactory and no questions remained then there would be no need for a rally.

peace

Well, my brother, I'm still

Well, my brother, I'm still waiting for those facts you mentioned. Maybe, you can pick them up at the rally and deposit a few of them here when you return. Until that time...

"All of those things

"All of those things together make it a very powerful, compelling set of facts that Yusuf Bey was involved and that Yusuf Bey should be charged, at a minimum, as an accessory to murder," said Peter Keane, a veteran criminal lawyer and dean emeritus of Golden Gate University Law School."

I want add one opinion, not a fact. I know Peter Keane although I have not talked to him in years. He served for many years as the second-in-command in the Public Defender's Office for the City and County of San Francisco. He is square business about protecting the rights of criminal defendants. I trust his opinion about Yusef Bey's involvement in the murder of Chauncey Bailey. You can call me any names you wish but that's how I feel about it.

I am D.O.N.E. with this discussion. Feel free to write whatever you want.

Artful Dodger

Well PT its been nice chopping it up with you, but since we are apples and oranges at this point, I will leave you with this,
1. Yusuf IV was the only Bey family member arrested during the raid and the last remaining Bey in the Bakery.
2. IV borrowed the keys to the murder van and returned them minutes after the murder per eye witness account
3. IV admitted to driving by and stalking CB's house the night before the murder
4. IV admitted to having the murder weapon before and after the murder and giving it the confessor before the RAID.
5. Per the tape he recounted the event as if giving first a hand account
6. Another man named Antoine Mackey was arrested in the raid but released and not charged even though there is eye witness accounts that he was seen driving the Van before and after the murder

so any other black man would have been charged as at least an accessory to murder from day one, their involvement is clear cut. There is nothing in my previous posts that support IV or suggest his innocence.

Where you miss the point is OPD has been helping IV tear up the Bakery and community for the last 2 years in the form of Detective Longmire who is the lead investigator and who IV brags is protecting him. There are proven incidents over the past 2 years where Longmire has intervened by using his authority to help IV out of trouble and has publicly admitted to being his mentor. IV attorney is on record saying Longmire is like a big brother to IV.

Since there has been 99% of the Bey family who disputes his leadership since the rightful CEO of the Bakery Waajid Bey was kidnapped and found murdered in a shallow grave in 2004, isn't it strange that his greatest ally who has helped him stay out of jail and in control of a bunch of violent teenagers is an OPD officer who is the "former" head of the OPD Police Intelligence Unit whose responsible for investigating and Raiding the Bakery? If he wasn't acting in an undercover capacity as a provocateur.
Q. Why is this man still in charge of the CB investigation?
Q. Why did he let IV speak to the so-called killer without taping the conversation in the interrogation room?
Q. Why does the official confession not match the notes or recorded questioning?
Q. Why didn't they question the inconsistencies in his story that didn't match case facts?
Q. Why wont they anser exactly when they knew CB was targeted?
Q. Why wont they answer basic questions surrounding the case?

I understand how comfortable it is in the Matrix for some people where facts are inconvenient to surreality, there's a boat load of provable facts above ( put a little effort into Google before you dismiss then or better yet call your friend Mr. Keane ) choosing to deny the facts exist wont change them because facts are independent of individuals

Your continued staunch support of law enforcement in the face of facts leads me to believe you are an officer yourself in which case peace out

The COINTELPRO theory...

You know, I really didn’t know what to make of the whole situation at first, but after doing a little bit of homework, reading the info that Rick Ross and the Chauncey Bailey project compiled:

http://www.rickross.com/groups/bakery.html

http://www.chaunceybaileyproject.org/2008/06/25/was-oakland-police-department-scared-of-muslim-bakery/

My take is kind of what it was when I saw the 60 minutes report.

It reminds me a lot of what occurred in Philadelphia with the MOVE situation, which is that law enforcement was trying to deal with a potentially volatile situation as diplomatically as possible without inciting or endangering the public interest.

Maybe I’m still missing something, but I still don’t see how law enforcement would gain from Bailey’s death. If anything, it appeared as if he was doing the leg work that law enforcement benefited from.

I do think that eventually you’ll find that there were more than a few officers, Longmire included, who exercised extremely poor judgment in trying to address the situation.

(I, too, have wondered what would have happened with the Panthers without the advent of COINTELPRO and if George Jackson had ever got out of prison alive, but I’m not certain how this would have related to the Bakery…)

But anyway you look at it, it’s a fascinating case. The back story on the elder Yusef Bey, in and of itself, is enough to ponder over as to what would have ultimately occurred had he actually lived to go to trial.

I'll begin to believe in the

I'll begin to believe in the efficiency of programs like COINTELPRO when folks who called themselves revolutionaries take some responsibility for not setting up counter-intelligence units within their organizations. If folks say that it was beyond their means, I will point out that the Chinese Communist Party had sophisticated counter-intelligence units operating during the 1920s. The Party infiltrated and spied on the Nationalists and other political rivals.

Soap Opera

Reality is Chauncey Bailey was in fact working on an expose of corruption in the Oakland Police Department, something that is never reported in the media. This is the publisher and owner of the POST newspaper that CB worked for.

http://www.youtube.com/watch?v=YHOlYF3VK-A

He is no apologist for the Bakery, so this is what he was saying almost a year ago, since then more information has come out that raising questions about OPD's handling of the case. If you care enough to look past the media barrage against the Bakery you will see more evidence that there is a cover up going on. Again if OPD is simply doing their job then why create the atmosphere of doubt and distrust.

Bottom line is the police may not have ordered the hit on CB but they didn't try to stop it either even with prior knowledge based upon the operation they were running inside the Bakery. They helped create the dangerous environment that caused CB to be collateral damage and now they are working hard to keep the hidden hand covered.

To quote CB "don't get side tracked by the media soap opera, its alot deeper than that"
RIP CB

The end of the beginning...

From a certain perspective, I can see how the police response to Bailey’s death could seem very dodgy. In so far as the OPD being implicated in homicides, is it an indictment of the entire department, or certain individuals within the department? That the evidence was provided to the OPD and that they in turn turned over to internal affairs, to me gives the impression that it speaks to select individuals. The lack of response would seem logical if no more than not wanting to jeopardize an active investigation.

If it was a departmental indictment, it would seem to beg the question as to why you would provide evidence to the very source your trying to bring down to give them an opportunity to devise a game plan to refute it.

That’s not to say I doubt that Bailey was actively working the story, but exactly what are the particulars and why hasn’t the story come out yet? The CB project website states they are actively engaged in bringing the truth to light, but my impressions were that the story was imminent to see the light of day.

Again, I may have missed something somewhere, but I didn’t see where his home or office place had been vandalized, so wouldn’t this mean his editor already had a working copy of the story for review? What would keep him from running it? If anything, I’m thinking it’s all the more incentive to get it to press ASAP.

Or, was this a story that Bailey was just getting started on? If so, what would precipitate the sense of urgency to have him eliminated? And how is it that they would go after Bailey, but the ‘Bey’ brother who was on 60 minutes is still walking the street? Is he in witness protection?

(…His face wasn’t blurred and his voice wasn’t modulated. How is it that he’s not a target?)

What exactly is the difficulty in getting the ‘true’ story to see the light of day?

My thinking is that either the OPD is actively working on weeding out misconduct within the department, or if the entire department is the issue, the facts need to be presented and addressed to a much higher governing body.

I am that brother

As for the Bey brother on 60 minutes that's me, am I in danger? the same danger that I have been in since they assassinated the first CEO and took over the Bakery 2004 in a coup, then intimidated the sisters who sat on the corporate board and then forged control of the bank accounts then proceeded to embezzle the family/corporate assets. Since control of the Bakery came down to either shooting it out inside the Bakery to oust the armed faction led by Antar and backed by a "Tommy" with an active FBI case against him ( please see the movie Belly ). We the older generation well studied in COINTELPRO realized that this would lead to everyone getting arrested and the trap being sprung to destroy remaining legitimate male leadership and therefore destroy the Bakery.

We the legitimate side still controlled all the other family businesses that employed and supported well over 150 people. Plus the majority of workers inside the Bakery were women and youngsters. So my brother and I decided not to retaliate violently and instead strategically moved to legally block them from liquidating any further assets in an attempt to regain control of the Bakery. Pinned down financially and lacking the business expertise to run a 40 year old business, 18 months later 4 gunmen ambushed my brother in front of his house with his family inside ( he survived ) but had to leave the state to protect his family and recover 6/2005. After that is was a matter of survival with these people enjoying unfettered free reign to attack us at will all the while OPD had us in a fish bowl waiting for the war to start. ( we have proof they suppressed evidence that would have led to their arrest and our regaining control ) They shot at me a couple months later as an intimidation attempt since I am the last remaining officer, but because they know I'm well trained and armed they being cowards know they run a high risk of not returning from a mission against me, so yes I watch my back constantly .

In 10/05 Tommy's puppet and co coup leader was killed in a "car jacked" where officer Longmire took the lead. Tommy disappeared and the 19 year old younger brother stepped into leadership of the a 40 year old business ( 2x his age ) He promptly went and destroyed 2 liquor stores on tape that went CNN worldwide, he was "befriended" by Longmire who became his replacement big brother and got him out of jail and continued to keep him in power all the while he was tearing up the community with violence and mayhem leading a gang of out of control teenagers. Because of his youth and ignorance he believe he was "untouchable" and couldn't be stopped when in truth we knew he was being set up and OPD was just amassing a list of charges for the right time. All this while OPD infiltrated, instigated and propped him up allowing him to be on 5 bails simultaneously and have outstanding no bail warrants. After short a while with no business sense he handed the Bakery over to the Federal government in an illegal Bankruptcy, Seeing that the end game was near I went to Mayor Dellums, Barabara Lee, our state and county representatives to ask for an independent investigation of how OPD had been manipulating the situation to the endagerment and pending loss of the Bakery, they all wrote me letters of support addressed to the Bankruptcy judge stating the Bakery was an Oakland institution and should be saved, but would not go out on the limb politically for the investigation of the police. At which time I fatefully ran into Chauncey Bailey who I had known for a long time and had been asking me for the inside scoop, I told him the story and he said he was working on a story about the police too. I asked him to notify the black community through his paper that this trick was going down and he said he wanted to do a series of articles outlining how the Bakery was taken over and was being taken from the community in an illegal bankruptcy that the feds knew was based upon fraud but were pushing it through. Congresswoman Barbara Lee wrote another letter to the judge asking him to delay until we could sort this out and he granted a 20 day stay. we wee poised to regain control of the Bakery.

Chauncey's editor killed the story and refused to run it, someone in the his office leaked the existence of the story to IVth who was slated to go to jail on forgery conviction but the judge sentenced him then released him stating he could add his time to his other pending cases that hadn't even gone to trial yet. Then coincidently the day before a 250 police raid on the Bakery because of a kidnapping and torture case Chauncey was hit and the press tried to crucify and link the black politicians support of our regaining control of the Bakery to support of the murders and they scattered for their political lives leaving us dangling and a fast track of liquidating the Bakery based upon the "animals" that killed Chauncey. ...I apoligize for the brain dump but thats 4 years of drama in a small box, please excuse syntax run ons and any missed details any questions I would be glad to answer

Well, I should have watch

Well, I should have watch this thread.

I hadn't heard anything about this case in a year. The tape and the accompanying article gave me a real Rodney King moment...like, they got shit like that ON TAPE, after reading him his rights, and someone is trying to act like Bey IV isn't in it?

For the record, Sandman, pt ain't a cop. He's a good man and even now I'd give Keane a clean slate in a first conversation based on his opinion. That said, and more importantly, a good man was executed a year ago, and another good man's legacy was chewed up and spat out.

For what it's worth, I'm on your side. And if that Hotmail address is valid (hey, you're not registered) I'll send you an email address...you can hit me with links to news reports or anything you want to say about the situation and I will post it.

Reading P6's post reminded

Reading P6's post reminded me of something I neglected to mention up thread. I have no doubts at all that there are corrupt and rogue embedded elements in the Oakland Police Department. Oakland's police department was notoriously racist during the 1940s, 50s, 60s and 70s. Later, when blacks began to gain more control over the city's government this racist element was tamped down somewhat, but the underlying culture of moral, ethical and criminal corruption, which always infects police departments where the abridgment of residents' civil rights is standard operating procedure, remained in place.

The police departments of both Oakland and San Francisco were long considered only several rungs above the Keystone Cops by other law enforcement officials and departments across the nation. Danny White, a former policeman and the man who assassinated San Francisco Mayor, George Moscone, and Board of Supervisors member, Harvey Milk, told me one night in 1974 inside the Balboa Park police station that "...every goddam night somebody from the neighborhood gets dragged in here and I know they haven't done a damn thing."

Danny and I had grown up in the same section of Visitacion Valley, a multi-racial working class neighborhood in San Francisco, and we had attended the same high school although he graduated earlier because he was two years older than me. What had prompted Danny's exclamation was his great surprise at seeing me in the station that night. A friend, who had been a football teammate of Danny's and, later, student body president, and I had been stopped on the street by presumably for the crime of being black and walking down the street. Danny told me that such incidents had convinced him to leave the police department and join the fire department. I have never understood why he lost it later and killed two people who I knew and liked, too.

Thank you 6

I like your site so I just registered and plan on participating in the threads as I can. And please feel free to to contact me whenever,
I have a Google alert set for Chauncey Bailey and your sites thread popped up. I want to thank you for being out there because 99.9% of the alert hits are just regurgitating the initial mis reporting. It was refreshing to find you and the conscious threads/people you have going here. I will take your word on PT and extend a brotherly greetings of peace to both of you.
