Officer Passed Blood-Alcohol Test 7 Hours After Fatal Accident

An off-duty New York City police officer charged with driving under the influence after his sport utility vehicle struck and killed a woman in Brooklyn early Sunday had no alcohol in his system when a blood test was performed seven hours later, a law enforcement official said Tuesday.
The officer, Andrew Kelly, 30, has been suspended from the force. The accident, which occurred about 1 a.m., killed Vionique Valnord, 32.
In court on Sunday, Officer Kelly pleaded not guilty to the charges, including vehicular manslaughter. Police officers who responded to the scene said Officer Kelly showed signs of intoxication and smelled of alcohol, according to a criminal complaint.
While one defense lawyer who works on drunken-driving cases said the lack of a blood-alcohol reading could complicate the case, a spokesman for the Brooklyn district attorney’s office, Jerry Schmetterer, said, “We are confident that there is enough circumstantial and physical evidence that we can get a conviction in this case.”
Officer Kelly refused to take an alcohol test at the scene. He did submit to a test in the hospital about 8 a.m. to comply with a warrant signed by a judge, Police Commissioner Raymond W. Kelly said Tuesday.
